Humana Health Sued for a Healthcare Data Breach

Humana’s Healthcare Data Breach
In the fall of 2020, Humana was struck by a healthcare data breach that exposed the personal information of around 65,000 of its health plan members. The organization only recently notified those whose information had been compromised and provided them with the option for extra services as a remedy to the situation.
Humana contracted another company, Cotiviti, and that company partnered with a subcontractor who provides medical record requests. An employee at the subcontractor company, Visionary Medical Systems, was authorized to access patient data for Humana. However, the lawsuit claims that the employee inappropriately disclosed data to individuals on Google Drive.
Class Action Lawsuit Following Healthcare Data Breach
Now, months later, a patient affected by the breach is filing a lawsuit against Humana and Cotiviti. The main force behind the lawsuit is the delay in notifying patients and the lack of information given when the notification finally came out.
The lawsuit also claims that Humana and the vendors did not properly handle protected health information per standards connected to PHI. As the employee was able to retrieve and upload sensitive patient information easily online, the lawsuit also claims that the companies failed to implement robust security measures. They did not properly secure, encrypt, or maintain patient information according to industry standards.
